MOBILE APP PRIVACY POLICY FOR PLAZA APP

This is the mobile app privacy policy for the PLAZA APP for Plaza Las Américas and Plaza del Caribe. To review our practices and changes, including this policy, you can consult our User Information and Data Retention Policy.

What information is collected from you.

We are the sole owners of the information collected on this Website and from your interactions with Plaza Las Américas or Plaza Del Caribe. We will not sell or rent this information to anyone.

Personal information is any information used to identify, locate, or contact you. This is the type of information we collect from you:

  • Contact Information that allows us to communicate with you like your name, username, address, telephone number, email address or social media profiles.
  • Relationship Information from doing business with us that allows us to personalize content for you like shopping or payment preferences and any other related information.
  • Information about your Interactions with Plaza Las Américas or Plaza de Caribe, such as registration, log-in, use of our products or services, Websites or Apps, cookies, and other technologies that may include geolocation services, browsing history, and social media interactions.
  • Communications with Plaza Las Américas or Plaza Del Caribe like customer service centers, including recordings of calls for quality and training purposes.

  • We will also use your information to personalize content for you and for marketing purposes. We will not share your information with any third party outside of our organization.  We will only share your information with our service providers for marketing and personalization purposes.
  • Unless you ask us not to, we may contact you via email, phone number, mobile app and mail address in the future to tell you about specials, new products or services, or changes to this policy.

We will share your information with our service providers only in the ways that are described in this policy.  Whenever possible, only aggregated, anonymized data is transmitted to external services to improve our service.

Sweepstakes & Contests

To participate in online sweepstakes, contests or promotions (collectively “Promotions”), we may require you to register and provide us with personal information. This User Information and Data Retention Policy applies to Promotions we may administer online, including through social media, mobile app, or digital platforms. We will use the information you provide us for purposes of registration and for purposes of administering the applicable Promotion, and such other purposes disclosed at the time of registration. You should carefully review the Official Rules of any such Promotion in which you participate since they may vary in each individual occasion.

We may operate Promotions jointly sponsored or offered by third parties that may require registration or submitting personal information. If you choose to participate in any such Promotion, your personal information may be disclosed to third parties as described in the terms applicable to that Promotion and our User Information and Data Retention Policy. By participating in a Promotion, you are agreeing to the official rules that govern that Promotion, which may contain specific requirements of you including, except where prohibited by law, allowing the sponsor(s) of the Promotion to use your name, voice, likeness, or other indicia of persona in advertising or marketing associated with the Promotion. If you choose to enter a Promotion, your Personal Information may be disclosed to third parties or the public in connection with the administration of such Promotion, including, without limitation, in connection with winner selection, prize fulfillment, and as required by law or permitted by the Promotion’s official rules, such as on a winners list. Mobile Application Policy

This policy governs your use of the software App Plaza Las Américas & Plaza Del Caribe (“App”) for mobile devices that was created by Express Image Digital. This App is a guide to stores, events, offers and promotions of Plaza Las Americas Shopping Mall located in San Juan, Puerto Rico and Plaza Del Caribe Shopping Mall located in Ponce, Puerto Rico.

 What information does the App obtain and how is it used?

  • User Provided Information
    • The App obtains the information you provide when you download it from either the Google Play Store or Apple’s App Store. We also obtain access to the information you provide when you register to use the App. In case you decide to register using third-party credentials, we will only collect the information as allowed by these third parties in accordance with the permissions you have previously granted them.
  • Registration with us is optional. However, please keep in mind that you may not be able to use some of the features offered by the App unless you register with us.
  • When you register with us and use the App, you generally provide (a) your name, email address, telephone number and other registration information; (b) transaction-related information, such as when you make purchases, respond to any offers, or download or use Apps from us; (c) information you provide us when you contact us for help; (d )information you enter into our system when using the App, such as preferences, interests or contact information.
  • We may also use the information you provided us, to contact you from time to time, to provide you with important information, required notices and marketing promotions.
  • Automatically Collected Information
    • In addition, the App may collect certain information automatically, including, but not limited to, the type of mobile device you use, your mobile devices unique device ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browsers you use, and information about the way you use the App.

Location Information

  • When you visit the mobile App, we may use GPS technology (or other similar technology) to determine your current location in order to identify the city or place you are located within and display a location map with relevant information (like where you parked your car) or advertisements. We will not share your current location with other users or partners.
  • If you do not want us to use your location for the purposes set forth above, you should turn off the location services for the mobile App located in your account settings or in your mobile phone settings and/or within the mobile App.

Data handling and Security

How We Protect Your Information

We are concerned about safeguarding the confidentiality of your information. We provide physical, electronic, and procedural safeguards to protect the information we process and maintain. For example, we limit access to this information to authorized employees and service providers who need to know that information for marketing purposes or to operate, develop or improve our service. Please be aware that, although we provide reasonable security of the information we process and maintain, no security system can prevent all potential security breaches.

Storage

We only store information as specified in policy.  We do not store more information than that needed for our marketing and content personalization purposes.  Every 24 months we purge information that does not serve the purposes as specified in this policy. 

Data Retention Policy

Data Retention Period

We will retain User-provided data as long as you use the App. We will retain Automatically Collected information for up to 24 months after you have stopped using the app (unless otherwise required by law or court order) and thereafter may store it in aggregate. If you would like us to delete User Data that you have provided via the App, please contact us at privacy@plazalasamericas.com and we will respond in a reasonable time. Please note that some or all of the User Provided Data may be required in order for the App to function properly.

Opt-Out Rights

You can stop all collection of information by the App easily by uninstalling the App. You may use the standard uninstall processes as may be available as part of your mobile device or via the mobile App marketplace or network. You can also request to opt-out via email, at privacy@plazalasamericas.com.

Children’s Online Privacy Protection Act 

We do not solicit data from or market to children under the age of 13. If a parent or guardian becomes aware that his or her child has provided us with information without their consent, he or she should Contact Us. We will delete such information from our files within a reasonable time.

CCPA

If you are a consumer as defined by the California Consumer Privacy Act (“CCPA”), you have certain rights in relation to your personal information under the CCPA. Under the CCPA, you have the following additional rights:

  • If you reside in California, you have the right to ask us one time each year if we have shared personal information with third parties for their direct marketing purposes. To make a request, please send us an email, or write to us at the address listed below. Indicate in your letter that you are a California resident making a “Shine the Light” inquiry.
  • If you reside in California, you can make the following more specific requests with respect to your personal information:
    • Access – You can request that we disclose to you the categories of personal information we collected about you, the categories of sources from which we collected the personal information, the categories of personal information we sold or disclosed, our business or commercial purpose for collecting and selling the personal information, the categories of third parties with whom we shared the personal information, and the specific pieces of personal information we collected about you over the past 12 months.
    • Deletion – You can request that we delete your personal information that we maintain about you, subject to certain exceptions. We DO NOT sell your personal information. For purposes of this User Information and Data Retention Policy, “sell” means the sale of your personal information to an outside party for monetary or other valuable consideration, subject to certain exceptions set forth in applicable California law.

You must provide us your mobile number voluntarily on our Website, App, point of sales or email marketing communications.
